
This Customer Service Agreement (the "Agreement") governs all the terms and
conditions associated with your use of the services offered by or through
Flatrateonline Corporation through Flatrateonline.net
Online Acceptance
Flatrateonline sells services online. By signing up for the
service and accepting the terms and conditions, both customer
and Flatrateonline agrees that the customer’s online
acceptance of Flatrateonline’s Terms of Use will carry
the same legal authorization as if the customer is providing
a handwritten signature of acceptance.
Terms And Conditions

Services Provided
Flatrateonline offers long distance services on a pre-paid
basis. The customer does not need to change long distance
carriers. The system is accessed by using a touch-tone phone
to dial an access number enter the Personal Identification
Number (“PIN”) provided by Flatrateonline and
dialing the called party. Flatrateonline is not responsible
for reimbursements of calls made with another service while
Flatrateonline is temporarily unavailable.
Opening an Account
To become a Flatrateonline customer, you must complete a registration
form, provide a valid credit card number and select a pre-set
non-refundable dollar value of services you wish to purchase.
Your email address will be used as your user name and you
will select a password at the time of registration. After
a purchase is made, you will receive an email with confirmation
of your purchase and a link for retrieving your account information
in a secure environment on our web site. You must use your
Username and password to retrieve account information via
the web site, sign up for additional services or recharge
your existing product.
Billing
Flatrateonline requires a credit card number for credit verification
and payment of charges. By providing Flatrateonline with your
credit card information, you are granting authorization for
the submission of charges. You have the option of voluntarily signing up for auto-recharge. If you sign up for auto-recharging, you are also authorizing recharges
when the balance of your account falls below $4.00 (All accounts are set
to manual recharge, you the customer has to select Auto Recharge
under Account Management section or during the check out process if you so desire). You have
the right to change your account to manual recharges by calling
customer service or changing your auto-recharge status online on the "Pin Details"
screen of the Online Account Management
system. Flatrateonline may refuse to offer service if credit
card is determined to be unsatisfactory. Acceptance of credit
shall be at Flatrateonline’s sole discretion.
Our products are on independently maintained switching facilities. If you have a problem we will resolve it with your current product or move your remaining balance to another product on a different switch to resolve the issue. ALL SALES
ARE FINAL.
Username, Password, PIN and Pass Code
YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY
OF YOUR USERNAME, PASSWORD, PIN AND PASS CODE. YOU AGREE TO
PAY FOR ALL SERVICES CHARGED TO YOUR ACCOUNT WHETHER OR NOT
YOU HAVE AUTHORIZED SUCH USE. If you believe that your account
is being used without your authorization, you are required
to contact Flatrateonline and change online password within one calendar
day. Flatrateonline is not responsible for actions taken by
individuals other than the customer who has access to the
email address provided to us by the customer. The customer
is responsible for maintaining a secure email address.
Payment
FLATRATEONLINE’S SERVICES ARE PROVIDED ON A PREPAID
BASIS ONLY. As you use Flatrateonline’s services, your
Account will be debited accordingly. No phone services will
be provided if your Account does not have a sufficient balance
to cover the cost of the service.
Payphone Surcharges
Flatrateonline charges a 0.89 cents payphone fee for calls
made from payphone to compensate payphone operators in accordance
with FCC (Federal Communications Commission) regulations.

Recharges
Your account can be set for automatic or manual recharges.
Accounts set for automatic recharge, will incur a charge equal
to the recharge amount when the balance falls below $4.00.
The default setting is manual recharge, you must click the
auto recharge box during check out or log into account management
and select auto recharge if you would like your account set
to auto recharge. If you have any questions or concerns about
recharges please call customer service at 1888-891-8991.
Cancellation
You can cancel your account by submitting a written request to
support@flatrateonline.net.
Invoices/Call Records
Flatrateonline does not send invoices to customers. All billing information is
available on the web site in the Online Account Management system. You may download your call details on the call history screen.
Billing Disputes
You must notify Flatrateonline in writing of any disputed charges within thirty
(30) days of the charge being posted to your Account
(support@flatrateonline.net). Flatrateonline will attempt to resolve all
disputes within thirty (30) days of being notified of a dispute. To the extent
Flatrateonline determines, at its sole discretion, that a billing adjustment is
warranted, your Account will be credited accordingly. If you fail to notify
Flatrateonline of a billing dispute as noted above, you will waive all rights
to bring any claim regarding the dispute.

Release
Flatrateonline shall not be liable or responsible for any
damages, losses, obligations, liabilities, claims and expenses
(including reasonable attorneys' fees and other costs and
expenses of any suit, action, investigation, claim or proceeding)
of any kind whatsoever, which are the result of, or are in
any way related to, your use of the Web site, Flatrateonline’s
services, and/or your transactions/communications with third-party
vendors initiated via the Web site. Such a release will include
Flatrateonline, directors, employees, agents, shareholders,
licensors, suppliers, its affiliates, their sub-carriers,
subcontractors and any third party information providers to
the Web site. Flatrateonline shall not be held liable or responsible
for any damages, losses, obligations, liabilities, claims
and expenses (including reasonable attorneys' fees and other
costs and expenses of any suit, action, investigation, claim
or proceeding) of any kind whatsoever, sustained or incurred
by a user because of undelivered e-mails or problem completing
a call.
International Calls
Although the quality of international telephone calls has
improved greatly in recent years, calls to certain countries
outside the United States can be interrupted as a result of
service/network issues in those countries. Flatrateonline
will attempt to identify any such issues, with the cooperation
of the customer. All necessary information must be provided
including date, time, origination number and destination number
on the support page. HOWEVER, FLATRATEONLINE WILL NOT REFUND
ANY CHARGES FOR SUCH INTERRUPTED CALLS.
Rates
Flatrateonline rate tables are written on the rates link on the web site at
flatrateonline.net. Rates are variable based on changes in market conditions.
Flatrateonline cannot guarantee that the rates will not change. Flatrateonline
reserve the right to change the rates at any time. You are responsible for
verifying the rates before making a call.
Rates are based on calls originating from the lower 48 States. Calls
originating from Canada, Hawaii, Alaska, Puerto Rico, Guam, Saipan, Mariana
Islands and the US Virgin Island will incur higher per minute rates to
compensate for the higher cost of transporting the toll free number.
Changes to Terms and Conditions
This Agreement may be modified or amended by Flatrateonline at any time. Unless
otherwise provided, all such modifications or amendments shall be effective
immediately upon posting on the Web site under Terms and Conditions.
Furthermore, customers will be asked to verify acceptance of these terms when
they signup and recharge their account. YOUR CONTINUED USE OF YOUR ACCOUNT
AFTER THE NOTICE PERIOD WILL BE CONCLUSIVELY DEEMED TO BE ACCEPTANCE OF ANY
SUCH MODIFICATIONS.
